Can you be arrested for drunk driving when you are not behind the wheel of a car and the engine isn't running? Apparently this is not a trick question in Indiana.

That's not a trick question anywhere, actually, Gail. Trust me, I know this stuff. For example, if you have the key in your possession, or accessible to you, you are presumed to be able to drive the vehicle. In this case, for the purposes of the law, they were "operating" the vehicle, and could presumably have lost control of it, or pushed it into oncoming traffic, etc.
They don't screw around with this stuff anymore.

Intuitively, it seems like it should be more a "drunk and disorderly" charge than a DUI.
